Robert Lazaro Clarke Leyva appeared in the Summary Court today, July 2, 2026, for allegations of affray, resisting a police officer, assaulting a police officer and carrying an offensive weapon.  He was released on bail with conditions.

Crown Counsel from the Office of the Director of Public Prosecutions said that the case against is “exceptionally strong” and is supported by CCTV footage from Bananas and Chicos bar, statements from multiple police officers and civilian witnesses, and medical evidence confirming injuries to Officer Brian Marshall.

DPP Crown Counsel added that, although Clarke Leyva is Caymanian, “there’s a possibility of him being a flight risk.”  DPP Crown Counsel appeared to take this approach because of the seriousness of the offences and Clarke Leyva has a Cuban passport (Clarke Leyva explained that he is a Caymanian and an “exempted Cuban” who has connections and living in Cayman for a long time).

Although DPP Crown Counsel highlighted that Clarke Leyva has a previous conviction for assaulting police, the Chief Magistrate noted that the offence occurred ten years ago and “There is a presumption for bail.”

The Chief Magistrate added:

 I can put in place conditions which prevent him from being at nightclubs and restrict his movements, we can protect the public.

In the circumstances, the Chief Magistrate granted bail with the following conditions:

** Surrender Cuban passport to the court by July 3

** Not to go within 100 yards of any liquor-licensed premises, except for work

** Observe a curfew from 7:30 pm to 6:00 am

** Check in at West Bay Police Station every Saturday between 9am and 5pm

** Doorstep checks (no answer will result in a breach

The Chief Magistrate also ordered DPP Crown Counsel to serve the outstanding CCTV footage from Bananas and Chicos on defence counsel by close of business on July 3.
