Adrian Gordon, a Jamaican national employed as a construction worker at a West Bay Road site, appeared via video link in Summary Court today, October 14, 2024, to request bail for an incident where it is alleged that he raped a bartender.
The alleged incident
Gordon’s lawyer, Stacy-Ann Kelly, explained the circumstances surrounding the alleged incident.
According to Gordon’s lawyer, on Friday, October 11, 2024, Gordon went to some bars in George Town and consumed a few drinks. He reportedly had CI$3,100, which was his salary from work, on him.
Gordon’s lawyer highlighted that during the evening, Gordon reportedly became friendly with the alleged victim and, “at some point, there was an agreement for sex at a charge of $300.”
Gordon’s lawyer added:
Mr Gordon says that initially he said that he only had $200, but eventually agreed to pay the $300. Having made the agreement, they then left the bar.
Reportedly, Gordon and the bartender later arrived at the bartender’s apartment, where he parked his vehicle across the street rather than in the parking lot. All of this is reportedly captured on CCTV.
Gordon and the bartender then allegedly entered the bartender’s apartment.
Gordon’s lawyer then explained, “After that, the video does show… that both parties run out naked.”
Gordon’s lawyer added:
I don’t think they have on socks. And there is some sort of a struggle where the victim is pulled back into the apartment.
Then she runs out again minutes later. And Mr Gordon is seen acting strange, in a strange manner, to say the least, in that he comes out, he starts to open the car door of a silver Honda fit that is in the parking lot of the apartment complex.
Gordon’s lawyer noted that, based on the CCTV video, the car Gordon was trying to open was not his own as it was a Honda Fit situated in the parking lot rather than his BMW, which was across the street.
Gordon’s lawyer observed that Gordon eventually opened another vehicle which was not his.
Reportedly, Gordon eventually made it back to the alleged victim’s parking lot, where he leaned against a car.
Gordon’s lawyer explained that, shortly after, the police arrived. Gordon opened the back door of the police car and got in.
As to what reportedly occurred next, Gordon’s lawyer explained:
He came to his senses at the hospital, and as soon as he did, his question to the officers was, where is my money, where is my wallet? And why am I here?
Based on the foregoing, Gordon’s lawyer suggested that Gordon “was not acting in his right mind.”
Bail application
After a summary of the alleged incident was presented, Gordon’s lawyer asked Magistrate McFarlane to consider granting Gordon bail with conditions.
Magistrate McFarlane granted bail under the conditions below.
Gordon must:
- Sleep every night at his residence
- Report at the West Bay police station on Mondays, Wednesdays and Fridays between 6 pm and 7 pm
- Have no direct or indirect contact (including social media) with the bartender
- Not attend the bartender’s home address.
- Not attend the bar where the bartender works in George Town
- Complete a curfew from 8:00 pm to 6:00 am
- Surrender all travel documents
- Provide a Caymanian surety for CI$1,500
Magistrate McFarlane informed Gordon that a breach of bail conditions could result in a bail revocation.
Magistrate McFarlane then noted that the rape charge would be transmitted to the Grand Court, where Gordon’s first hearing will occur on Friday, October 18.
Special order of no publication of the identity of the victim
Lastly, Magistrate McFarlane ordered that, pursuant to section 31 of the Criminal Procedure code, there shall be no report or publication of the proceedings which may lead to the identification of the alleged victim.
