Dane Orlando Facey appeared in the Summary Court today, May 12, 2025, to face charges of possessing 30.36 kilos of ganja with intent to supply, careless driving and speeding. Magistrate Gunn sentenced him to 16 months for the Ganja and fined him $300 for speeding. Crown counsel from the Director of Public Prosecutions offered no evidence of the careless driving charge, which was dropped.
Background
According to DPP Crown Counsel Brown, on January 28, 2025, police were given information that the driver of a silver Jeep Cherokee was transporting illicit drugs along Shamrock Road towards George Town.
Initially, police tried to engage Facey by flashing their lights. However, Facey ignored them.
Reportedly, Facey turned into the YARL development and increased his speed. Unfortunately, Facey lost control of the vehicle, went airborne, hit an embankment, and landed in a ditch.
Upon searching the vehicle, police found several bags containing ganja.
When Facey was interviewed in March 2025, he provided a prepared statement saying that he accepted that he was in possession of the ganja in the vehicle and that he was going to supply it to another person.
Reportedly, Facey did not know who he was delivering the ganja to or how much he was transporting.
Sentencing
Attorney Oliver Grimwood argued on Facey’s behalf and explained that Facey was asked whether he could transport something from one location to another.
Grimwood added that it was only when the vehicle was en route that Facey smelled ganja. At that stage, he was aware of what he was transporting but decided to keep going.
Grimwood continued:
It’s out of character for him.
He is someone who is employed.
That’s continued even whilst in prison.
Grimwood concluded:
He is using his time to attend church.
It’s something that he did where before he was remanded.
It’s something that he continues to do afterwards.
He understands that he must accept responsibility for the position to put himself in and understand the implications that we’ll have for his life.
After hearing from DPP crown counsel and defence counsel, Magistrate Gunn sentenced Facey as follows for the ganja:
Description | Sentence |
Starting Point | 30 months (2.5 years) |
Reduction for early guilty plea | -(1/3) |
Reduction for good character | -(6) months |
Total | 16 months |
Facey’s time in custody since March 2025 will be deducted from the above sentence.
In the case of speeding, where he was caught doing 40 mph in a 25 mph zone on Fairbanks Road, Magistrate Gunn fined him $300 or, alternatively, spend one day in prison. Since he reportedly had no financial means, it is understood that he will spend an extra day in prison, bringing his total time to 16 months and one day.
For the careless driving, the DPP crown counsel offered no evidence.
Facey was informed of his right to appeal.
