Mark Kennedy Bush appeared in the Grand Court on November 15, 2024, to face indictment 131/24, where he was charged with assault occasioning actual bodily harm and threats to kill. He pled not guilty.
Regarding the allegations, the Court Marshall explained that the alleged assault causing actual bodily harm occurred on September 10, 2024, on Watercourse Road in West Bay, where he is said to have unlawfully assaulted a woman occasioning her actual bodily harm.
Concerning the threats to kill, the Court Marshall said that on the same date and place, it is alleged that Bush made a threat to another person, intending that that person would fear it would be carried out to cause serious harm.
Bush’s trial date was set for January 28, 2025, and is expected to last 3 days.

The offence of assault occasioning actual bodily harm is covered by section 216 of the Penal Code. This states: “A person who commits an assault occasioning actual bodily harm commits an offence and is liable to imprisonment for five years.”
The offence of threats to kill is found in section 88C of the Penal Code. This states:
(1) A person who without lawful excuse makes to another person a threat, intending that person would fear it would be carried out, to (a) kill; or (b) cause serious harm to, that person or a third person commits an offence and is liable to imprisonment for ten years.
(2) A threat may be committed in a public place or a private place.
(3) A constable may arrest, without a warrant, anyone that constable reasonably suspects is committing an offence under this section.
