Vivian George Campbell appeared in the Summary Court today, December 4, 2024, to face a charge that he overstayed in the Cayman Islands for 20 months. The Chief Magistrate sentenced him to 4 months in prison and ordered that he be deported afterwards.
Background
Regarding the background, Campbell’s lawyer, Attorney Lene Doherty, explained that he applied for a temporary work permit, however, it was deferred. In the circumstances, he sought an extension of time on three occasions.
Campbell’s stay was further lengthened by the fact that his father got into an accident.
Sentencing
Discussing mitigating factors, Campbell’s attorney explained that he is only 25 years old, worked as a car washer and had no previous convictions. She also noted that Campbell pled guilty early to the charge against him.
After hearing from legal counsel, the Chief Magistrate warned Campbell that the normal penalty is $20,000 and up to five years imprisonment.
The Chief Magistrate highlighted that “twenty months is a long time” and his overstaying seemed “deliberate.” The Chief Magistrate added that Campbell cannot ignore immigration laws.
In the circumstances, the Chief Magistrate sentenced Campbell to four months in prison, with time in custody to be taken into consideration. Additionally, the Chief Magistrate ordered a deportation recommendation.
