Fayona Annmarie Barnes appeared in the Summary Court today, February 13, 2025, to face a charge of failing to comply with an enforcement notice. Kenneth Ferguson, Crown Counsel from the Office of the Director of Public Prosecutions, however, notified the Summary Court that the charge was being withdrawn.
Explaining the reason for the withdrawal of the charge, Crown Counsel said that Lookout Holdings was served a notice as the original owner of the land. While Lookout Holdings reportedly provided a copy of the notice to Ms Barnes, this was not deemed to be a provision of proper notice. In any event, her name was never on the land register.
Given the circumstances, Crown Counsel said the charge would be withdrawn.
The Chief Magistrate noted the withdrawal of the charge and advised Ms Barnes that she was free to go.
