Today, Monday, June 2, 2025, Justice Richards placed Tyler Foster Scott on a two year probation order for using a forged $100 bill at Blackbeard’s Liquor store in Cayman Brac. He must also pay compensation of $100 to Blackbeard’s Liquor and complete 240 hours of community service within 12 months.
Background
Based on the facts, Scott went to a supermarket in Cayman Brac in September 2022. He tried to pay with a $100 note, however, the cashier declined to accept it.
Reportedly, Scott then went to Blackbeard’s to purchase cigarettes and rum. He was given change of $78.03.
After Scott left the store, the cashier examined the $100 bill and reported it to police.
Initially, Scott denied usage of a counterfeit note.
When interviewed, he recalled going to the supermarket but suggested that the money he used there was different from the one used at Blackbeard’s.
Scott’s denial of using the forged $100 bill changed when he entered a guilty plea in May 2024.
Sentencing
In court, Crown Counsel from the Office of the Director of Public Prosecutions suggested that the starting point for Scott’s offence should be two years in prison.
DPP Crown Counsel added there were aggravating factors to consider, including Scott’s nine previous convictions.
DPP Crown Counsel said further that there was:
- A loss of confidence and reputational harm caused to the Cayman Islands
- Inconvenience caused to third parties (going through the process of checking the forged note)
- Consequential financial harm
- Residual risk (had the forged note not been identified and placed in wide circulation)
Arguing on Scott’s behalf, Defence Counsel James Stenning noted that Scott suffered mental health challenges.
Stenning added that Scott recognised that he had an alcohol problem and made attempts to be rehabilitated.
In the circumstances, Stenning suggested that a 12 month probation order would be more appropriate than the two years mentioned by DPP Crown Counsel. Stenning added that a sentence of two years would be disproportionate to Scott’s offence.
After hearing from lawyers, Justice Richards said that a two year probation order (starting today) would be appropriate.
Probation conditions include that Scott must:
- Undergo a psychological assessment within the next two weeks
- Attend any programme ordered by his probation officer
- Attend the Counselling Centre for individual therapy
In addition, Justice Richards implemented a separate community service order requiring Scott to complete 240 hours of community service within the next 12 months.
Further, Scott must pay a $100 in compensation to Blackbeard’s or serve one month in prison.
