A woman appeared in the Summary Court this week facing allegations of possession of 935.29 grams of cocaine and 2.22 grams of crack cocaine. She pleaded not guilty to all charges.

The offences

Regarding the background of the offences, it was explained in the Summary Court that on June 24, 2024, the woman was allegedly in possession of the cocaine.  Then, on June 27, 2024, the woman was allegedly in possession of the crack cocaine.

Arguing on her behalf, her attorney explained that the real issue is that the prosecution is “vesting possession” of the cocaine in the woman.

He explained:

My client asserted that she didn’t live at the residence at the time.

There were two other persons at the residence.

He added:

One person seen running from the vicinity of residence that was chased and not caught by the police.

When my client was showed the items she said “clearly I’m being set up.”

She told the police where she lives. Her residence was never searched there’s an indication that one of the other persons at the location was interviewed.

He continued:

I have no indication as to what happened relation to the investigations of those two persons and why they were not charged.

Request for bail

The woman’s attorney also requested that her bail conditions be varied so that she could be allowed to travel to obtain material needed for her construction company.  Without this, her business could remain stifled.

In the circumstances, the Chief Magistrate noted that the Court could not take the risk of someone “deciding to relocate themselves” when the Court had this type of charge against them.

Notwithstanding this, the Chief Magistrate agreed that bail conditions could be varied if the woman fulfilled the condition of providing a $10,000 cash bond that would guarantee her return to Cayman. She must also provide her contact details and an itinerary for each trip seven days in advance.  Once the foregoing is done, the stop notice for her at the airport will be lifted.

Trial date

Regarding her trial, it was noted that a case management hearing would occur on February 27, 2025, and the trial date would be April 15, 2025.
