The Crown summed up its case against Theodore O’Neil Morgan on October 4, 2024, explaining to the jury allegations that Morgan stalked and relentlessly harassed another man who is Morgan’s ex-lover.  In addition to stalking, the Crown suggested that Morgan was a “jilted lover” who took matters further by allegedly committing a reckless and negligent act by swerving his Mercedes towards his ex-lover and ex-lover’s fiancée while they were out jogging. Reportedly, Morgan’s ex-lover, described by the Crown as a “vulnerable man,” suffered fear due to the ordeal.

Stalking

As explained in Court, Morgan’s ex-lover arrived in Grand Cayman from South Africa in February 2020. Morgan and the man subsequently became friends with intimate relations.

The intimate affair allegedly started to go wrong when Morgan’s ex-lover subsequently met a woman and began a relationship with her.

It is alleged that between April 2022 and April 2023, Morgan intentionally engaged in a course of conduct towards the man on two or more occasions, which caused the man to fear for his safety. For this, Morgan was charged with stalking under section 155 of the Penal Code.

The alleged series of events were as follows:

  1. In 2022, while Morgan’s ex-lover was getting dressed in his bedroom at 5:30 am, he allegedly saw Morgan running by his window. Reportedly, this was the first time the ex-lover saw Morgan doing this.
  2. In another incident, it was reported that Morgan’s ex-lover and his new girlfriend were sleeping in bed. Allegedly, Morgan entered their house’s main bedroom and took the girl’s phone that was lodged between Morgan’s ex-lover and the ex-lover’s girlfriend on their bed. Morgan later admitted that he had taken the phone.
  3. In a further incident, it is alleged that Morgan’s ex-lover went to the kitchen one morning to get some water and found Morgan in the house. At this stage, the ex-lover realized Morgan had a house key.
  4. On another occasion, it is alleged that Morgan was found at the home dumping a female’s belongings from her gym bag on the lawn.
  5. It was alleged that one day when the ex-lover was going to work, the ex-lover noticed that someone urinated on his Audi vehicle. The ex-lover alleged that it was Morgan who did this.
  6. At some stage, the ex-lover and Morgan got into a scuffle, where the men allegedly started pushing each other. Morgan allegedly placed his hands around his ex-lover’s neck, suffocating him. Reportedly, a female who was present asked Morgan to stop squeezing his ex-lover’s throat.

Other incidents allegedly occurred, including Morgan observing the man while working out at the Camana Bay gym.

Additionally, it is alleged that Morgan followed the man on his morning run and threw liquids towards the man and his fiancée when they were on their morning run.

Swerving the car recklessly toward his ex-lover

The second charge faced by Morgan is an alleged reckless and negligent act under section 210 of the Penal Code.

Regarding this, the Court heard that on May 23, 2023, in the vicinity of Bella Close, West Bay, Morgan allegedly drove his Mercedes Benz in a public place in a manner that was so rash or negligent as to endanger human life or safety.

Morgan’s ex-lover and fiancée were reportedly running on Esterley Tibbetts highway.  Morgan allegedly cut a corner and accelerated towards his ex-lover and fiancée.

Justice Richards explained various elements that the prosecution must prove, including subjective and objective questions, for the jury to consider whether Morgan was reckless and negligent in this alleged act.

Justice Richards is expected to conclude her case summary on November 7, 2024. After that, the jury will consider all the evidence and deliver a verdict based on the facts.

In the meantime, Morgan has reportedly denied that he stalked his ex-lover and didn’t understand why that allegation was made. In addition, Morgan reportedly maintained that his ex-lover gave him a spare key to the home and did not go to the house uninvited. He also denies any reckless or negligent act in relation to the alleged incident involving his car swerving towards his ex-lover because he was never at the scene of the alleged incident.
