A man appeared in the Summary Court this week to face three charges of indecent assault, however no details of the incidents were provided. The man was released on bail and, in the meantime, the Chief Magistrate ordered that the prosecution make certain disclosures to defence counsel.

Regarding disclosures, the defence counsel noted they have not yet received the transcript and audio of the an interview and there were unused materials in the disclosure bundle that were not served. The Chief Magistrate ordered that the Office of the Director of Public Prosecutions provide these documents within seven days.

Regarding the bail conditions, these are as follows:

** Provide a $3,000 surety.

  ** Surrender his passport to the court (work-related travel is possible with prior submission of itinerary and location details)

** No contact with the complainant or any prosecution witnesses (including via social media or third parties).

  ** Must reside and sleep at the address given to the court

Reporting restrictions

The Chief Magistrate noted that there are media reporting restrictions in place to protect the identities of all parties involved.. So, no person shall publish anything that may directly or indirectly identify the parties on social media, any newspaper or otherwise.
