Yesterday, January 30, 2025, Franklin Elwin Martinez, a truck driver, appeared in the Cayman Brac Summary Court to face a charge of failing to provide a specimen of DNA for a laboratory test. After pleading guilty to the charge, he was fined $500 or will serve 50 days in prison in default of payment. Additionally, he was disqualified from driving for 14 months.

Background

Regarding the background of the incident, crown counsel from the Office of the Director of Public Prosecutions explained that on June 1, 2024, PC Sheppard was dispatched by 911 operators to a road traffic collision near Tibbetts Enterprises.

When officers arrived, they saw Martinez. 

While Martinez had no visible injuries, the officers smelled alcohol.  As a result, they requested a blood specimen, which Martinez refused.

Sentencing

In the Summary Court, Magistrate Gunn asked Martinez why he refused to provide a DNA specimen.  Martinez said he “was nervous” because of the impact of the traffic collision.

Martinez added that since the accident, he has been assisting the other truck drivers by dispatching.

After hearing from Martinez, Magistrate Gunn fined him $500, or he would serve 50 days in prison in default.  He was also disqualified from driving for 14 months, backdated to December 12.  Therefore, the disqualification will be until February 12, 2026.

Magistrate Gunn warned Martinez that he must not apply for a licence while disqualified, or he could face prison.
