Tommy Orlando Ebanks appeared in the Summary Court today, February 12, 2025, to face charges of criminal trespass and theft of alchohol from an Ithmar Circle residence. He pleaded guilty to the charges.

Regarding the theft, it was alleged that between May 20 and 21, Ebanks dishonestly appropriated property belonging to Graham Rankin with the intention of permanently depriving Rankin. The property included seven cans of beer, two bottles of port, one bottle of vodka, one bottle of Jack Daniels, and ten bottles of wine.

Concerning the criminal trespass, it was alleged that, on the above date, Ebanks entered 91 Ithmar Circle.

After considering the matters, the Chief Magistrate remanded Ebanks in custody.

Ebanks will face sentencing on February 25, 2025.

Theft is covered under section 241 of the Penal Code. This states as follows:

Theft

241. A person who commits a theft commits an offence and —(a) where the value of the thing stolen does not exceed five thousand dollars, is liable on summary conviction to imprisonment for seven years; and(b) where the value of the thing stolen exceeds five thousand dollars, is liable on conviction on indictment to imprisonment for ten years.

Criminal trespass is covered by section 277 of the Penal Code. This states:

Criminal trespass

277 (1) A person who, without having lawful business thereon, enters upon the premises
of any private residence or upon land belonging to any proprietor or occupier
which is enclosed or in any manner cultivated commits the offence of criminal
trespass and is liable to a fine of one thousand dollars and to imprisonment for
one year.
(2) A person who unlawfully and maliciously cuts, breaks, barks, roots up or
otherwise destroys or damages any plant, fruit, vegetable production, tree,
sapling, shrub, or any underwood growing in any place commits an offence and
is liable to a fine of two thousand dollars and to imprisonment for two years or,
if the offence is committed in any pleasure ground, garden, orchard or avenue,
or in any ground adjoining or belonging to a dwelling house, to a fine of three
thousand dollars and to imprisonment for three years.
