A man appeared in the Summary Court today, June 17, 2025, to hear the result of a preliminary inquiry relating to allegations of procuration of a child for sexual activity and sexual communication with a child. The Chief Magistrate ruled that there was sufficient evidence to commit the matter to the Grand Court. The man is scheduled to appear in the Grand Court on June 27, 2025. His bail was extended until then.
Reporting restrictions
Due to concerns for the child, the Chief Magistrate ordered that no publication shall be made that could directly or indirectly identify the child. Further, no publication shall be made of the name of the man as it may lead to the identity of the child.
Note to readers
Procuration of a child for a sexual activity is covered under section 228H of the Penal Code. This states:
(1) Where a person, being eighteen years or older, engages in any conduct with intent to procure a child under the age of sixteen years, to do anything which if done would involve or lead to the commission of an act of a sexual nature that person commits an offence and is liable on — (a) summary conviction; or (b) conviction on indictment, to imprisonment for a term of eight years.
Sexual communication with a child is covered under section 228E of the Penal Code. This states:
(1) Where a person, being eighteen years or older, for the purpose of obtaining sexual gratification — (a) knowingly engages in communication of a sexual nature with a child under the age of sixteen years; or (b) encourages a child under the age of sixteen years to make or engage in a communication that is sexual or relates to a sexual activity, that person commits an offence. (2) A person who contravenes subsection (1) is liable on — (a) summary conviction; or (b) conviction on indictment, to imprisonment for a term of six years.
