A man appeared in the Summary Court on October 1, 2025, to face multiple charges of unlawful gambling. Magistrate Gunn noted that the court is considering a prison term and set a further hearing for December 3, 2025.
Magistrate Gunn highlighted that there were three offences which were committed within a short period of time, which she referred to as being “very serious.”
Magistrate Gunn inquired whether gambling was the man’s primary source of income, and it was confirmed that this was indeed the case.
His attorney, Stacy-Ann Kelly, explained that a combination of factors needed to be considered in this case. She said:
He’s up in age.
He has a difficulty with his vision.
She added:
Some of the money that was recovered, not all of it, was from the sale of numbers. Some of it was from his N.A.U. cheque.
Regarding the cash seized, Crown Counsel from the Office of the Director of Public Prosecutions explained they separated some aspects of the cash, but they would need to confirm certain details to determine whether the full amount should be seized or a smaller amount.
After hearing from counsels, Magistrate Gunn indicated to the man that he needs to have a further meeting with his attorney. In the meantime, she gave him a custody warning, saying, “You are at risk of going to prison because you have three offences of gambling.” A further meeting with his attorney will allow him to make submissions to the court, persuading Magistrate Gunn not to send him to prison. The man was bailed to return to court on December 3, 2025.
