The alleged stalking case of Rushane Wayne White came before the Summary Court on Tuesday, July14, 2026; however, it was adjourned after the court heard the Office of the Director of Public Prosecutions did not have two videos — taken by the alleged victim — that the defence says it is entitled to see.

Defence counsel John Furniss told the court that the papers served referred to two videos taken by the alleged victim and asked for copies. DPP Crown Counsel, the court was told, “does not have” them. The Chief Magistrate pressed DPP Crown Counsel on the point, asking whether that was not “material that should have been ready to be produced,” and noted there had been “long discussions with the Crown about disclosure matters” with “the issues” continuing.

Following discussion, the outstanding material was ordered to be produced by DPP Crown Counsel to defence counsel by July 24, with the matter to return on August 11. The defendant was reminded of his bail conditions.

Note to readers

The central issue was the DPP’s failure to produce the alleged victim’s videos — an ongoing disclosure problem the court noted was recurring.  This results in case delays, increased legal expenses for defendants, and a waste of valuable time for judges and court assistants. It also leads to a situation where alleged victims are left without a resolution or a resolution is delayed until the DPP can get its disclosures in order.

The proceedings describe allegations only; the defendant is presumed innocent until proven guilty.
