A man appeared in the Summary Court this week to face several counts of common assault against a former intimate partner.  He pleaded not guilty to the charges.

The offences

Regarding the offences, it was alleged in the Summary Court that on April 23, 2024, the man allegedly pushed his former lover, threw her to the floor and repeatedly kicked her.   He was also accused of pushing her again on April 25, 2024.

Further, the man was accused of assaulting the woman by holding her down and choking her on June 20, 2024.

Concerning a September 2024 incident, it was alleged that he assaulted her by grabbing her to the neck and slapping her in the face.

Lastly, it was alleged that the man damaged the woman’s iPhone.  This was the only offence that he pleaded guilty to.

Victim allegedly recants

Notwithstanding the assault allegations, the man’s attorney claimed that there was a statement from the victim “indicating she did not wish to proceed.”

In response, the prosecution said:

We have no prior indication that there was a request for us to take any further statement from the complaint. But a complainant can always go back to the police station and give that statement rather than try to change that.

Next steps

After hearing from prosecution and defence counsels, the Chief Magistrate set a February 7, 2024 trial date.
