Today, June 30, 2025, Nirdesh Suresh Thakur, an employee at the Kimpton, was fined $100 by Magistrate McFarlane for theft of $42.74 worth of goods from Foster’s Supermarket in West Bay. Magistrate McFarlane recorded a conviction notwithstanding his lawyer’s request not to do so.

Background

As explained by Crown Counsel from the Office of the Director of Public Prosecutions, on November 26, 2024, Thakur left the Foster’s Supermarket West Bay location without paying for bodywash, avocados, listerine and a tube of cream. The items were valued at $42.74.

When interviewed, Thakur reportedly accepted going to Foster’s and paying for some items but not all. He was stopped by the store manager while leaving the store.

Sentencing

Arguing on Thakur’s behalf, his lawyer explained that he is a 34-year-old man from India who came to the Cayman Islands to work at the Kimpton.

Reportedly, his wife had recently given birth to their first child. As a result, his income was “diminished.” This appears to have influenced the commission of the offence.

His lawyer suggested that, based on the 2024 sentencing guidelines for dishonesty, the offence was one of lesser culpability since there was little or no planning. In addition, the incident resulted in lesser harm.

In the circumstances, his lawyer recommended a discharge and that no conviction be recorded.

After hearing from counsels, Magistrate McFarlane agreed that the offence involved lessser culpability and harm. However, she queried why Thakur didn’t ask friends or colleagues for assistance when he found himself in a tight financial situation.

After noting the foregoing and the excellent character reference provided by the Kimpton, Magistrate McFarlane ordered that Thakur pay a fine of $100 or face one week in prison if not paid. She also recorded a conviction against Thakur.
