Two People Plead Not Guilty To Charge Of Failure To Pay Over $40,000 In Overtime Pay

Karen Angela Christian and Patricia Diania Montoya appeared in the Summary Court today, November 19, 2024, to face charges of failing to pay overtime.  They pleaded not guilty.

Regarding the joint charges, it is alleged that between July 2022 and July 2023, Christian and Montoya failed to pay Anna Peralta overtime pay of $40,462. In addition, it is alleged that between August 2023 and May 2024, overtime for $9,295 was not paid.

Concerning the appropriateness of the charge against Christian, her attorney, Richard Barton, informed the prosecution and the Summary Court that she is neither the employee nor the holder of the work permit for the person alleging failure to pay overtime. Therefore, it is unclear whether a charge was laid correctly against Christian.

Barton also noted that there is a statute of limitations point regarding the charges.  He indicated that he would write to the prosecution to explain the position.

While Barton communicates with the prosecution regarding the charges, Montoya and Christian are expected to return to Court on December 5 for a case management hearing.
