Today, July 18, 2025, opening statements were made in the Grand Court by Senior Crown Counsel Sarah Lewis of the Office of the Director of Public Prosecutions in the case of Selvyn Emmanuel Bailey. Bailey faces allegations of rape and indecent assault of a 16-year-old female while on a visit from Jamaica to Cayman in 2023. 

Regarding the rape allegation, the February 2024 indictment states that on or about August 11, 2023, at Apollo Links, George Town, Bailey had unlawful sexual intercourse with the young lady, aged 16 at the time, without her consent.

Based on the summary of the evidence presented by DPP Senior Crown Counsel, the young lady reportedly slept in one bedroom (where Bailey’s clothes were allegedly kept) while Bailey and his wife slept in another room.  The young lady reportedly did not have a lock on her room door.

Reportedly, on Friday, August 11, 2023, Bailey’s wife went away for a work conference, leaving Bailey and the young lady alone in the house.

Allegedly, that evening after Bailey and the young lady had dinner, she went to bed.

The young lady reportedly woke up around midnight to use the bathroom.  To her surprise, she was no longer wearing the shorts and underwear she had gone to bed in. These were on the side of the bed.

Reportedly, while she was using the bathroom, she felt a painful burning sensation, and she noticed blood. The young lady came to the view that she was assaulted by Bailey.

Reportedly, she called her boyfriend on Snapchat and explained what she thought occurred.  She remained in the bathroom until around 5 am on Saturday.

It is alleged that, before church on Saturday morning, she confronted Bailey about what happened the night before. Reportedly, Bailey initially told the young lady that nothing had happened. Subsequently, Bailey allegedly said that “it wasn’t supposed to happen,” but provided no explanation of what this meant.

When the young lady told Bailey that he had raped her, Bailey allegedly told her not to accuse him of something he didn’t do.

According to the allegation, what followed was that, later that day, Bailey put two 5,000 Jamaican dollar bills on her bed. Reportedly, the young lady said she didn’t want the money, and Bailey took it away.

Moving on to the indecent assault allegations, DPP Senior Crown Counsel said that on the Friday prior to the alleged rape, Bailey’s wife had apparently left the house early.  At the time, the young lady was in her room sleeping.

Allegedly, while she was in bed, she suddenly felt something and saw Bailey at the foot of the bed. She said she was “sleep paralysed,” explaining that she tried to move and just couldn’t. She added that the shorts and underwear she wore to bed were no longer on.

According to the allegation, Bailey was touching her vagina and then put his mouth there to perform oral sex. Reportedly, she pushed him away and went to the bathroom to cry.

Allegedly, when she left the bathroom and went downstairs, Bailey asked her if she enjoyed it.  She said “no.” Bailey also allegedly asked her if it was the first time someone had made her have an orgasm.

Regarding the last incident of indecent assault, it is alleged that sometime between when she arrived in July 2023 and the rape, she was trying on clothing and her aunt asked her to go downstairs and show the outfit to Bailey.

Allegedly, the young lady was not keen to do so but showed Bailey the outfit to oblige Bailey’s wife. At this time, Bailey allegedly inspected the clothing, rubbing his hand over her bottom.

Police involvement

Reportedly, on Monday, August 14, 2023, the young lady’s mother called her and asked if she had been sexually assaulted by Bailey. The young lady confirmed that this was the case, at which time, her mother ended the call to seek help. She hid in the bathroom until the police arrived.

When Bailey was interviewed by the police, he presented a prepared statement. The statement reportedly said that as soon as his wife went away, the young lady started to speak to him in an “overtly sexualized manner and tried to seduce him.”

Bailey added that the young lady asked him for money, but he refused to oblige. Reportedly, this, together with Bailey’s refusal of her advances, made her angry.

Reportedly, a break in the case occurred when a swab taken from inside the young lady’s vagina contained a match to Bailey’s DNA profile.

Bailey was then interviewed again.

During the second interview in September 2023, Bailey presented another prepared statement.

Reportedly, he explained that the presence of his semen or DNA inside the young lady was a result of the following factors:

** A shared laundry basket was used in the house by Bailey, his wife and the young lady

** He caught the young lady using his washrag in his bathroom on August 12, 2023, while she was doing a bubble bath

** On another occasion, he went into her bag (not wearing gloves) to look for her phone and her panties

**Lastly, he recalled that, on one occasion, he removed the young lady’s panties from the clothing line

Reportedly, when the police asked Bailey questions about the foregoing, including whether Bailey used the washrag to masturbate, Bailey referred the police to his prepared statement.

Subsequent to this interview, the police flew to Jamaica to interview the young lady.

Case continues

The case is scheduled to continue in the week of July 21, 2025, when witnesses or statements are expected to be heard. Those witnesses are expected to be cross-examined by Bailey’s attorney, Greg Walcom, a former prosecutor with the DPP.
