Today, July 29, 2026, a man who admitted living in the Cayman Islands without authorisation for well over a year has been warned that he could face a custodial sentence, after the Summary Court ordered a pre‑sentence report before deciding how to deal with him.

The defendant, named in court as Krishner Smith, pled guilty to a charge of overstaying, contrary to the Customs and Border Control Act. The particulars were that since March 29, 2025 he had remained and resided within the Cayman Islands without lawful authorisation to do so.

Appearing for the defendant, defence counsel Ms James-Malcolm told the court that, having spoken with Smith, there were “several mitigating factors” in his favour, and asked the court to order a pre‑sentence report to assist in the sentencing exercise.

The Chief Magistrate agreed to order a pre‑sentence report, noting that Smith was “at risk of going into custody.” these were “potentially custodial matters” and that the court would have to consider the mitigating factors counsel had indicated. The court confirmed that Smith’s passport was being held, and directed him to meet the probation officer, keep all his appointments, and return to court on September 21 for sentencing.

No sentence was passed at this hearing.  Smith remains to be sentenced once the pre‑sentence report is completed.
