In a move aimed at safeguarding a defendant’s right to legal counsel, the Summary Court today, June 16, 2026, ordered the in-person production of Ruel Romain Scille, for his upcoming hearing. This decision follows growing concerns raised by defence counsel regarding recent changes at Her Majesty’s Prison (HMP) that are severely hindering attorney-client communication.
Scille’s counsel, Stacy-Ann Kelly, explained to the Chief Magistrate that “things have changed drastically” at Her Majesty’s Prison, making it no longer possible for attorneys to call their clients directly. Furthermore, limitations on the provision of disclosure documents to inmates were cited as a significant challenge, impeding lawyers’ ability to adequately prepare cases. Kelly added that, even she was to scan the disclosure bundle and email to the prison, the prison will not print them for the inmates if the paperwork exceeded a certain size.
Given this unfortunate set of circumstances, Kelly noted that she may not have an opportunity to speak to her client to prepare for the upcoming hearing.
Recognizing the critical importance of attorney-client consultation, the Chief Magistrate ordered that Scille be produced in person for his next appearance, scheduled for the upcoming Thursday. This will allow counsel to meet with him directly and facilitate proper case preparation.
The Chief Magistrate’s directive underscores a commitment to ensuring fair legal processes, even as new operational policies at HMP present hurdles for both legal professionals and defendants. The upcoming hearing is expected to see Scille present in court, providing a crucial opportunity for consultation that current HMP protocols reportedly restrict. If the reported restrictions are not lifted, this may lead to challenges with inmates’ access to justice, inefficiencies with the court process, delays and unnecessary costs incurred for further adjournments.
